Operator and scope

SWD REAL ESTATE is operated by SW Real Estate trading as SWD Real Estate (Pty) Ltd., registration R756699, at Smithco Building, King Mswati III Avenue, Matsapha, Kingdom of Eswatini, M0200. These terms govern accounts and use of the South African SWD marketplace. Smith International Partners LLC is the disclosed United States merchant for SWD platform fees and subscriptions unless approved public facts state otherwise.

SWD provides technology for property discovery, listing management, enquiries, viewings and non-binding offer communication. SWD does not receive rent, deposits, purchase funds, conveyancing funds or other third-party money. SWD is a technology marketplace and does not represent that it is the appointed property practitioner for a listing merely by providing platform functionality. Any user acting as a property practitioner must hold and disclose every registration, Fidelity Fund certificate, mandate and other authority required by applicable law.

Eligibility and accounts

Users must have legal capacity, provide accurate information, protect account and second-factor credentials, and promptly report suspected compromise. Organisations must appoint authorised representatives and remain responsible for users acting within their workspace.

Identity, authority or property checks reduce risk but do not guarantee a person, organisation, listing, property condition, title or transaction. SWD may require additional evidence, restrict functionality or revoke sessions to protect users and the service.

Marketplace conduct

Users must comply with the Acceptable Use Rules, Safety and Fraud Policy, applicable law and all role-specific terms. Users may not misrepresent identity, authority, property, price, availability, fees or material conditions.

Enquiries, viewing requests and offers sent through SWD are communications between users. An offer is non-binding unless a separate legally valid agreement expressly makes it binding. Property transfer, lease conclusion, deposits, inspections, finance and conveyancing occur outside SWD unless a later approved product document expressly states otherwise.

Availability and changes

Country visibility does not mean transactional availability. SWD may keep a market page public while capabilities are future, launching, limited, live or suspended. A suspended capability remains unavailable even if a page or client control is visible.

SWD may change, limit or discontinue functionality for security, legal, provider or operational reasons. Material contractual changes requiring renewed acceptance take effect only through the versioned legal manifest and recorded re-acceptance process.

Content and intellectual property

Users retain rights in content they own and grant SWD a limited, worldwide, non-exclusive licence to host, process, reproduce and display that content only as needed to operate, secure and improve the contracted service. Users warrant that they have the rights and permissions required for submitted content.

SWD names, branding, software and platform materials are protected by applicable intellectual-property law. No right is granted except the limited right to use the service under these terms.

Enforcement and termination

SWD may reject, quarantine, unpublish or remove content and may suspend or terminate access when reasonably necessary to address risk, abuse, non-payment, legal duties or material breach. Where appropriate, SWD will provide notice and an appeal or support route, subject to urgent safety, fraud and legal-preservation needs.

Users may close an account subject to outstanding contractual duties, lawful retention and active dispute or fraud controls. Subscription cancellation and refunds follow the Billing and Subscription Terms and Refund and Cancellation Policy.

Warranties and liability

The service is provided with the rights and guarantees that cannot lawfully be excluded. Subject to those rights, SWD does not guarantee uninterrupted availability, transaction completion, property condition, title, identity, creditworthiness or user conduct.

To the maximum extent permitted by law, each party is responsible for direct loss caused by its own breach, negligence, fraud or unlawful conduct. Nothing in these terms excludes liability or statutory rights that cannot lawfully be excluded. A user is responsible for loss arising from unlawful content, false authority, misuse of the service or breach of these terms to the extent the loss was not caused by SWD.

Law and disputes

These terms are governed by the laws of the Kingdom of Eswatini, subject to mandatory consumer, privacy, property and electronic-commerce law applicable in the country where the service is supplied, without removing mandatory consumer or data-protection rights. Before formal proceedings, users should contact ops@swdrealestate.com so the parties can try to resolve the issue. The parties should first use the documented support and complaint process. If the matter is not resolved, either party may use a court or statutory dispute forum of competent jurisdiction. Nothing restricts a consumer or data subject from using a mandatory regulator, ombud, tribunal or court available under applicable law.
