South Africa Supplement and Privacy Rights Schedule

Application and precedence

This supplement applies to users and transactions enabled for South Africa. Mandatory South African rights prevail over inconsistent contractual wording.

Electronic supplier disclosures

Applicable industry memberships, codes and alternative dispute routes are any legally mandatory regulator, statutory code or dispute route applicable to the service; SWD does not present a voluntary industry membership as a substitute for statutory rights. Consumer protection

SWD will not exclude rights that cannot lawfully be excluded under the Consumer Protection Act or Electronic Communications and Transactions Act. Mandatory disclosure, cooling-off, cancellation, renewal and performance rights under applicable South African consumer and electronic-commerce law prevail. SWD presents the merchant, price, renewal interval, performance period and refund terms before payment and applies any non-excludable cancellation or cooling-off right.

Property-practitioner position

SWD operates the technology marketplace. A user who performs activities regulated as property-practitioner services must independently satisfy the Property Practitioners Act and related requirements, including applicable registration, Fidelity Fund certification, mandate and disclosure duties. Platform access or verification does not itself confer practitioner status or authority.

SWD does not receive rent, deposits, purchase funds, conveyancing funds or other trust money. No user should send such funds to SWD. If a later approved service changes that position, the relevant regulatory, trust-account, fidelity-fund and disclosure controls must be approved before activation.

Payments and tax

Smith International Partners LLC, a United States company at 3975 Lyndhurst Dr, Fairfax, VA 22031, United States, is the merchant for approved SWD platform fees. Prices are denominated in ZAR and processed by Stripe in an embedded component. SW Real Estate records VAT/TIN 105989134 and Smith International Partners LLC is the disclosed United States merchant for approved platform fees. Checkout and invoices state the merchant and tax actually applied. South African VAT is charged only when the controlled tax configuration confirms that charging is legally required or authorised; the platform monitors the applicable registration threshold and preserves transaction evidence.

POPIA schedule

The responsible party is SW Real Estate trading as SWD Real Estate (Pty) Ltd. and the Information Officer contact is Ralston Smith, ralston@tigerafrica.com. Processing purposes, categories, recipients, retention and security appear in the Privacy Notice.

The Privacy Notice identifies the responsible party, information categories, purposes, recipients, rights, security controls and contact route. Processing relies on the lawful basis applicable to the purpose, including contract, legal obligation, legitimate interests or consent where required, and data subjects receive the notice information required by applicable law.

Personal information is transferred outside South Africa only on a lawful basis with safeguards appropriate to the recipient and information, including adequate legal protection, binding contractual protection, consent where valid, or another transfer basis permitted by POPIA.

A data subject may use ralston@tigerafrica.com to request confirmation, access, correction, deletion, objection, restriction or consent withdrawal where applicable. Complaints may be lodged with the Information Regulator, subject to its current forms and procedures.

Governing law and contact

The Platform Terms use Eswatini law as the general governing law, but mandatory South African consumer, privacy, property and electronic-commerce law continues to apply where it cannot lawfully be displaced. South African users may use any court, regulator, tribunal, ombud or other forum that mandatory law makes available.
